- The Nashville company, Defiance Brands, Inc., sells products named DEFY LIMITATION and DEFY LIMITATIONS while the Denver-based company sells DEFY and DEFY FOR THE ACTIVE LIFESTYLE.
- The suit is seeking a court order for Defiance Brands, Inc. to stop using Defy’s Brand.
Defy LLC, a CBD sports drinks company in Denver, CO, has filed a lawsuit against a business in Nashville for selling products under a very similar name. The filed suit is pressing charges for copyright infringement.
The lawsuit, filed on June 26th in Colorado federal court, says that the Nashville Company, Defiance Brands, Inc., is selling products advertised as sports drinks with the names DEFY LIMITATION and DEFY LIMITATIONS.
The sports drinks that Defy sell are called DEFY and DEFY FOR THE ACTIVE LIFESTYLE.
The attorneys for Defy stated in the lawsuit:
“Through its significant investment, Defy has earned substantial goodwill and consumer recognition in the DEFY Marks for use in connection with nutrient-enriched beverages and related products.”
The suit is seeking a court order for Defiance Brands to stop using Defy’s brand. However, the U.S. Trademark Trial and Appeal Board had previously rejected a trademark appeal from the Stanley Brothers because it is not federally legal to add CBD to foods, drinks, or dietary supplements.
